In December 2022, governments from around the world met in Montreal to flesh out the details of a global biodiversity framework that would govern efforts to reign in biodiversity loss so steep that some have referred to it as “biological annihilation.”

This meeting – the fifteenth Conference of the Parties under the Convention on Biological Diversity – produced the Montreal-Kunming Global Biodiversity Framework, which observers have likened to biodiversity’s “Paris” moment.

What does the Montreal-Kunming Framework establish? What does it mean for the rights agenda? And how can litigators and practitioners ensure that this Framework has a real shot at success?
