Challenges of climate compensation: Non-economic loss and damage
Climate harms extend far beyond purely economic loss. Specifying and valuing non-economic loss is a necessary first step to achieve redress.
CLX Director of Programs Ashley Otilia Nemeth and student researcher Naina Agrawal-Hardin published an article in Open Global Rights discussing how the Torres Strait Islanders case demonstrates that greater specificity is needed when ordering compensation for non-economic harms and how this gap represents an opportunity for scholars and practitioners to help guide tribunals and courts.
